January 16, 2014 Minutes
The Telford Borough Authority Meeting held this date was called to order at 6:00 p.m. by Chairman Timothy Hagey, with the following members in attendance: Abram Diehl, John Harrell, David Musselman and Robert Nice. Also present were Manager Mark Fournier, Public Works Director Gary Yoder, Solicitor Mark Weand, Engineer Patrick DiGangi and Recording Secretary Megan McShane.
APPROVAL OF MINUTES: Minutes of the December 12, 2013 Authority meeting were approved unanimously (5-0) by a Diehl/Musselman motion.
COMMENTS FROM AUDIENCE:
There were no comments from the audience.
DISCUSSION ITEMS:
1. TMDL Update
Solicitor Mark Weand reported that the depositions scheduled for last month were cancelled; EPA has filed motions to stall the case. 50 entries have been entered on the docket and the Court hasn’t even gotten through discovery yet.
When EPA refused to appear at the depositions, Hall & Associates proceeded with filing sanctions. Robert Nice asked if TBA would consider EPA to be in contempt, and Solicitor Weand informed Mr. Nice that he and Manager Fournier discussed that with Hall & Associates, and the decision was made to file sanctions.
A lengthy discussion ensued. Manager Fournier reported that he and Mark Weand are very satisfied with the quality of work that is being done by Hall & Associates; they are working very hard on behalf of TBA.

TREASURER’S REPORT: accepted as presented
WATER DEPARTMENT REPORT: We received a written report for the file.
COLLECTION REPORT: We received a written report for the file.
WASTEWATER TREATMENT REPORT: We received a written report for the file.
PTWA REPORT: We received a written report for the file.
SOLICITOR’S REPORT: We received a written report for the file.
Solicitor Mark Weand informed the Authority Board that Secant Medical is proposing to purchase 551 E. Church Road, and that they applied for a special exception to the Zoning Ordinance, since Secant’s operation with certain materials utilized is situate in the outer wellhead protection zone. The Zoning Hearing Board granted the special exception, and the Zoning Hearing Board Solicitor is in the process of preparing an Opinion and Order, which is projected to contain protective conditions for the capture upon use and proper disposal of the materials in question.
Solicitor Weand also informed the Board that Vulcan Spring is moving forward with their building expansion project.
ENGINEER’S REPORT: We received a written report for the file.
Engineer Patrick DiGangi informed the Authority Board that CKS is currently compiling information for the TBA and PWTA Chapter 94 Reports.
Mr. DiGangi also informed the Board that Indian Ridge Provisions is getting ready to move forward with their expansion project after being on hold for a year and a half.
MANAGER’S REPORT: We received a written report for the file.
OTHER BUSINESS:
Payment of the bills and requisitions for the month of December in the amount of $ 225,588.47 was approved unanimously (5-0) by a Harrell/Nice motion.
Signing of the checks was approved unanimously (5-0) by a Harrell/Nice motion.
The meeting was adjourned at 6:58 pm with a Harrell/Musselman motion.
